Both Harry Malka and Ian Kravitz are certified as Circuit Court Civil Mediators by the Florida Supreme Court. In most Circuit Court civil cases, mediation is a mandatory step prior to going to trial. When disputes are brought into the mediation process, a mediator hears both sides of the dispute and assists the parties in developing a solution that works best for them. While mediation is not guaranteed to settle a dispute prior to trial, it is a collaborative process that allows the parties to determine the outcome of their case, instead of allowing a judge or jury to make the final decision. Both Messrs Malka and Kravitz are certified to act in this capacity, both individually, and under certain circumstances, as a team. They are each also qualified to act as a Private Trial Resolution Judge in cases where the parties wish to have their matter heard by an expert on construction law, in lieu of a trial court judge.

Oftentimes in construction settings, the contract at issue requires the parties to resolve their dispute through arbitration, instead of trial court litigation. This process is generally faster and less costly than a trial court litigation matter. Arbitration with Mr. Kravitz also guarantees that the decision maker deciding the dispute will be knowledgeable in issues related to construction disputes. In other instances, the parties simply choose to arbitrate their disputes in lieu of litigation. In either setting, Mr. Kravitz is qualified by the Florida Supreme Court as an arbitrator, and is available to serve in that capacity to assist in resolving your dispute through the arbitration process.
